1. Definitions

In these Terms and Conditions, the following terms shall have the meanings set out below:

"Company," "we," "us," "our" refers to Tầm Wheels, located at 261 Lê Thánh Tôn, Bến Thành, Quận 1, Hồ Chí Minh 70000, Vietnam.

"Service" refers to the vehicle rental services provided by Tầm Wheels, including vehicle supply, coverage, roadside assistance, and related services.

"Renter," "you," "your" refers to the individual or entity entering into a rental agreement with us.

"Vehicle" refers to any automobile rented through our service.

"Agreement" refers to the rental contract signed at the time of vehicle collection, together with these Terms and Conditions.

2. Acceptance of Terms

By making a booking inquiry, signing a rental agreement, or using our services, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, please do not use our services.

You must be at least 21 years of age and hold a valid driving license to enter into a rental agreement with us. International visitors must possess a valid International Driving Permit in addition to their home country license.

3. Service Description

Tầm Wheels provides vehicle rental services in Hồ Chí Minh City and surrounding areas. Our service includes the provision of a rental vehicle for an agreed period, vehicle orientation and walkthrough, applicable coverage as specified in your rental tier, and access to our roadside assistance line during your rental.

Vehicle availability is subject to our current fleet capacity. We reserve the right to offer a comparable or upgraded vehicle if your originally requested vehicle is not available at the time of collection.

4. Booking and Payment

Booking inquiries can be submitted through our website contact form, by phone, or by email. A booking is confirmed only upon receipt of a signed rental agreement and applicable deposit or payment.

We accept payment by major credit and debit cards (Visa, Mastercard), bank transfer, and cash in Vietnamese Dong (₫). A security deposit will be held on your payment card or collected in cash at the time of vehicle pickup. This deposit is returned upon satisfactory vehicle return.

All prices are quoted in Vietnamese Dong and include the coverage level specified for each rental tier. Additional services, such as a bilingual driver, are subject to separate charges as communicated at the time of booking.

5. Renter Responsibilities

As a renter, you agree to operate the vehicle in a safe and lawful manner in accordance with Vietnamese traffic laws. You shall return the vehicle at the agreed time and in the same condition as received, allowing for normal wear. You must not permit any unauthorized person to operate the vehicle, and you are responsible for all tolls, fines, and traffic violations incurred during your rental period.

You agree not to use the vehicle for any illegal purpose, for racing or speed testing, to transport hazardous materials, to tow other vehicles, outside the borders of Vietnam without prior written consent, or while under the influence of alcohol or drugs.

You must report any accident, damage, or mechanical issue to us immediately by calling our assistance line.

6. Mileage and Fuel

Each rental tier includes a daily mileage allowance as specified in the rental agreement. Kilometers driven beyond the daily allowance are charged at the per-kilometer rate agreed upon at the time of booking.

Vehicles are provided with a full tank of fuel and should be returned with a full tank. If the vehicle is returned with less fuel than provided, a refueling charge will be applied at current market rates plus a service fee.

7. Coverage and Liability

Each rental tier includes a specified level of coverage as outlined during vehicle orientation. Coverage applies to the vehicle itself and third-party liability as required by Vietnamese law. Coverage does not apply in cases of renter negligence, driving under the influence, unauthorized use, or violation of these terms.

The renter is responsible for any damage not covered under the included coverage, including but not limited to damage caused by negligence, damage to tires and windshield, loss of personal belongings, and damage caused by prohibited use of the vehicle.

8. Cancellation and Modification

We accommodate schedule modifications where possible. Changes to rental dates should be communicated as early as possible. Rate differences may apply for modified bookings.

Cancellations made more than 48 hours before the scheduled pickup time will receive a full refund of any deposit paid. Cancellations within 48 hours may be subject to a cancellation fee equivalent to one day's rental charge.

9. Intellectual Property

All content on the Tầm Wheels website, including text, images, logos, and design elements, is the property of Tầm Wheels and is protected under Vietnamese intellectual property law. You may not reproduce, distribute, or use any website content without our prior written consent.

10. Disclaimers

Our services are provided on an "as available" basis. While we maintain our vehicles to high standards and conduct regular inspections, we do not warrant that vehicles will be free from all mechanical issues during the rental period.

We are not responsible for delays, route closures, weather conditions, or other external factors that may affect your travel plans. Any route advice provided by our staff is based on experience and offered as a courtesy; it does not constitute a formal recommendation or advisory service.

11. Limitation of Liability

To the maximum extent permitted by Vietnamese law, Tầm Wheels shall not be liable for any indirect, incidental, consequential, or punitive damages arising from the use of our services, including but not limited to loss of profits, loss of data, or business interruption.

Our total liability in connection with any rental shall not exceed the total rental fees paid by you for the specific rental period in question.

12. Indemnification

You agree to indemnify and hold harmless Tầm Wheels, its owners, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from your use of our vehicles, your breach of these terms, or your violation of any applicable law during the rental period.

13. Termination

We reserve the right to terminate a rental agreement and require the immediate return of the vehicle if we reasonably believe that the vehicle is being used in violation of these terms, that the vehicle is at risk of damage or loss, or that the renter has provided false information.

In such cases, any prepaid rental fees will be refunded on a pro-rata basis, minus any charges for damage or violations.

14. Governing Law and Disputes

These Terms and Conditions are governed by and construed in accordance with the laws of the Socialist Republic of Vietnam. Any disputes arising from or relating to these terms or your use of our services shall be subject to the jurisdiction of the competent courts in Hồ Chí Minh City.

Before pursuing formal legal proceedings, both parties agree to attempt to resolve disputes through good-faith negotiation. If negotiation is unsuccessful, the parties may agree to submit the dispute to mediation in accordance with Vietnamese mediation procedures.

15. General Provisions

These Terms and Conditions, together with the signed rental agreement, constitute the entire agreement between you and Tầm Wheels regarding your use of our services. If any provision of these terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

Our failure to enforce any right or provision of these terms shall not constitute a waiver of that right or provision. We may not assign or transfer our rights under these terms without your consent, except in connection with a merger, acquisition, or sale of assets.

16. Changes to These Terms

We reserve the right to modify these Terms and Conditions at any time. Changes will be posted on this page with an updated effective date. Your continued use of our services after any changes constitutes acceptance of the revised terms. We encourage you to review these terms periodically.
